What is a SAP?
SAPs act as a neutral party, focusing on assessment and support rather than employment decisions. Those choices are left to the employer and their company policy. A Substance Abuse Professional’s role is to clinically assess and evaluate each individual, providing a personalized treatment or education plan in line with DOT protocol. The mission is to prioritize public safety, especially in DOT agencies' cases and USCG guidelines, where SAPs ensure employees are ready to return to safety-sensitive duties. Qualified DOT SAPs maintain specific qualifications as mandated by the DOT under 49 CFR Part 40.

Employer Responsibility
As an employer, if your employee or potential employee fails a DOT drug or alcohol test, DOT 49 CFR 40.287 mandates that you provide them with a list of qualified DOT SAPs (Substance Abuse Professionals). This list is essential for the individual to start the return-to-duty process. It's important to note that this requirement applies whether the employee continues to work for you or was never hired. The list you provide must be easily accessible to the employee and should include the names, addresses, and telephone numbers of the qualified SAPs. This ensures that the employee has the necessary resources to comply with DOT regulations and work towards resuming their duties.
